After the Shipwreck:
Confronting Malaysia’s Refugee Protection Crisis

Malaysia is currently host to more than 200,000 United Nations High Commissioner for Refugees (UNHCR)-registered refugees, a large majority of whom are Rohingya who have fled genocide at the hands of the Myanmar military, as well as mounting abuses by the Arakan Army and Rohingya armed groups in recent years. Despite this, Malaysia has neither ratified the 1951 Refugee Convention nor established a comprehensive domestic framework for refugees, continuing to rely on punitive immigration laws to criminalize, detain, abuse, and often deport people seeking protection.
In early November 2025, a shipwreck near the Thai–Malaysian maritime border claimed at least 29 lives, including five children. Instead of receiving humanitarian assistance and protection, Malaysian authorities have instead charged survivors with immigration-related offences.
The upcoming Fort Talks will discuss Malaysia’s current approach to refugees, the situation of Rohingya survivors in Thailand, and assess the effectiveness of the actions of Association of Southeast Asian Nations (ASEAN) and its members. Speakers will explore the recent drivers of forced displacement and the impact of Malaysia’s punitive policies on refugees in the country.
This event will be held in both English and Thai languages, with simultaneous translation provided. It is open to the public and free of charge.

ปัจจุบัน ประเทศมาเลเซียดูแลผู้ลี้ภัยที่ขึ้นทะเบียนกับสำนักงานข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ (UNHCR) กว่า 200,000 คน โดยส่วนใหญ่เป็นชาวโรฮีนจาที่หลบหนีการฆ่าล้างเผ่าพันธุ์โดยกองทัพเมียนมา ตลอดจนการละเมิดสิทธิมนุษยชนที่ทวีความรุนแรงขึ้นจากกองทัพอาระกันและกลุ่มติดอาวุธโรฮีนจาในช่วงไม่กี่ปีที่ผ่านมา แม้จะมีสถานการณ์เช่นนี้ มาเลเซียยังมิได้ให้สัตยาบันอนุสัญญาว่าด้วยสถานภาพผู้ลี้ภัย ค.ศ. 1951 และยังมิได้จัดตั้งกรอบกฎหมายภายในประเทศที่ครอบคลุมเพื่อคุ้มครองผู้ลี้ภัย โดยยังคงพึ่งพากฎหมายคนเข้าเมืองเชิงลงโทษ ซึ่งนำไปสู่การเอาผิด การคุมขัง การละเมิด และบ่อยครั้งรวมถึงการส่งตัวกลับประเทศสำหรับผู้แสวงหาความคุ้มครอง
เมื่อต้นเดือนพฤศจิกายน พ.ศ. 2568 ได้เกิดเหตุเรืออับปางใกล้เขตแดนทางทะเลไทย–มาเลเซีย ส่งผลให้มีผู้เสียชีวิตอย่างน้อย 29 ราย รวมทั้งเด็ก 5 ราย แทนที่ผู้รอดชีวิตจะได้รับความช่วยเหลือด้านมนุษยธรรมและการคุ้มครอง เจ้าหน้าที่มาเลเซียกลับตั้งข้อหาผู้รอดชีวิตด้วยความผิดเกี่ยวกับการเข้าเมือง
การเสวนา Fort Talks ครั้งนี้จะพูดคุยหารือถึงแนวทางปัจจุบันของมาเลเซียต่อประเด็นผู้ลี้ภัย สถานการณ์ของผู้รอดชีวิตชาวโรฮีนจาในประเทศไทยที่เคยอยู่ในประเทศมาเลเซีย และประเมินประสิทธิภาพของสมาคมประชาชาติแห่งเอเชียตะวันออกเฉียงใต้ (อาเซียน) และประเทศสมาชิกในการหาทางออก ผู้ร่วมเสวนาจะวิเคราะห์ปัจจัยล่าสุดที่ก่อให้เกิดการพลัดถิ่นโดยบังคับ และผลกระทบของนโยบายเชิงลงโทษของมาเลเซียที่มีต่อผู้ลี้ภัยในประเทศ
วงเสวนานี้จัดขึ้นเป็นภาษาไทยและภาษาอังกฤษ โดยมีล่ามแปลทั้งสองภาษา และเปิดให้เข้าร่วมได้โดยไม่มีค่าใช้จ่าย
